HOW TO ENTER
To be eligible to enter, entrants must purchase a specially marked Chupa Chups singles or bagged product from any participating retailer and consume the product to reveal the hidden entry code printed on the lollipop stick.
Entrants must then either;
• SMS the keyword “chupa” together with your name, full address including postcode and entry code to 199 222 00 during the promotional period; or
• Log onto http://www.lifelessserious.com.au and follow the prompts and enter your details including the entry code as directed during the promotional period; or
• Entries can also be made via the Chupa Chups free “Roller Coaster Around The World” mobile application during the promotional period.
TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Any costs associated with entering the promotion, including accessing the promotional website, are the responsibility of each entrant.
3. Entry is open to permanent residents of Australia only. Entrants under the age of 18 years must obtain the consent of their parent or legal guardian to be eligible to enter. Employees of the Promoter, their immediate families, related companies, directors, management and associated agencies with this promotion are ineligible to enter.
4. Maximum cost of SMS entry is $0.55c including GST. The SMS service provider is Infodial Australia Pty Ltd. The cost of sending an SMS message is the entrant’s responsibility and will vary dependent on the mobile network used. The charges for all SMS entry services will appear on each entrant's next mobile phone bill. Some service providers and call plans may not provide access to premium SMS. The SMS entry mechanic is only open to consumers with an SMS compatible mobile phone, permitting text messaging to the premium rate Promotional SMS number. Entrants must check with their service provider if unsure and all queries relating to mobile bills should be directed to the entrants' mobile phone carrier. SMS entries via the Internet are not valid and will not be accepted. Minors should seek bill payer’s permission before entering.
5. The promotion commences at 00.01am AEDST on 16/01/2012 and closes at 11.59 pm AEST on 25/05/2012 (“Promotional Period”).
6. Consumers may enter the promotion as many times as they like but they must retain each original Chupa Chups stick with the corresponding unique code to verify their purchase(s) if required by the Promoter. Incomplete, indecipherable or illegible entries will be deemed invalid.
7. Offer is not valid in conjunction with any other special, discount or promotion offer unless indicated otherwise.
8. There will be 3 Major prizes in total. The first 3 valid entries drawn will each win a Family Round the World Trip for 4 people valued at Maximum RRP $23,286.67 AUD per trip depending on point of departure and date of travel, which includes:
Round the world economy airfares for four people flying Qantas, Lufthansa & United Airlines with stops in Japan, Europe & the US valued at AUD $12,340.67 inclusive of all airport, airline & government taxes; and
4 nights accommodation at Hilton Nagoya Hotel Japan in 2 x standard twin rooms valued at AUD $2,000.00 and 5 day Japan rail pass for 4 valued at AUD $1420.00; and
4 nights accommodation at Europa-Park Resort, Erlebnishotel Collosseo in 2 x hotel room including breakfast daily valued at AUD $3000 and 3 day pass Europe Park Germany for family of 4 valued at AUD $430.00; and
4 nights accommodation Radisson Hotel of Freehold - New Jersey in 2 x queen rooms valued at AUD $2800.00 and 2012 season pass for Six Flags Adventure Park valued at $280 and 5 days car hire valued at AUD $450.00; and
Travel insurance based on family of 4, with AUD $30000 cancellation cover, nil excess valued at AUD $566.00
9. Total maximum value of prizes is RRP $69,860.00 AUD. Prizes are not transferable or exchangeable and cannot be taken as cash. All other applicable taxes (excluding GST) and surcharges on the prize tickets and all ancillary costs involved, including excess baggage above the permitted 30 kg, Visas, valid passports, spending money, meals (other than those included), transfers, items of a personal nature, in-room charges, insurance and any applicable insurance excesses and any other ancillary costs, not listed in the travel prize package descriptions above are the responsibility of the winner and his/her nominated companions as incurred. It is the winner's responsibility to organise and pay the cost of transport to/from each airport departure/return point.
10. All travel is subject to availability at all times and maybe dependent on select seat class with airlines or specific room category availability with accommodation partner. Entry is open to those who are available to travel between 30/06/2012 and 31/03/2013. The prize must be claimed and used in its entirety by 31/03/2013. However, travel will not be available during the block out period, from 1/12/2012 until 31/01/2013. All bookings and documentation regarding the prize must be made via Escape Travel South Yarra, Shop 8, 210 Toorak Rd, South Yarra VIC 3141 or their agents at least 60 days prior to travel. Redeeming the prize is conditional on acceptance of the terms and conditions of travel as detailed by Escape Travel South Yarra, Shop 8, 210 Toorak Rd, South Yarra VIC 3141 and the airline carriers in accordance with normal travel practices. In the event the winner is under the age of 18 years, they must be accompanied by a parent/guardian. Winner and companions must be in possession of a valid passport with a minimum of 6 months validity on it prior to departure, with appropriate visas and travel insurance. Winner is responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed. Frequent flyer points will not form any part of the prize. Winner may be required to present credit card at time of accommodation check in.

12. The prize draws will take place on the 31/05/2012 at Level 3, 554 Church Street Richmond VIC 3121, Australia, at 09.00 am AEST. All valid entries received during the Promotional Period will be entered into each prize draw.
13. Entrants can only enter in their own name. The Promoter reserves the right to request all entrants to produce (within a reasonable period of time) appropriate photo identification or other documentation (to the Promoter's reasonable satisfaction) in order to confirm each entrant's identity, age, residential address and email address, eligibility to enter and any information submitted by the entrants in entering the promotion, before issuing the prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an entry has not been verified or validated to the Promoter's satisfaction within the time requested, that entrant's entry will become invalid.
14. The winners will be notified in writing via email within five (5) working days of the draw and winners will be notified on the client website located at www.lifelessserious.com.au and all names will be published in The Australian on 08/06/2012. Prizes will be delivered within 28 days from notification of the prize being won or any other period that may be agreed between the promoter and the winner. If the winner of the prize is under the age of 18 years, that prize will be awarded to the winner’s parent or guardian on behalf of the winner.
15. The Promoter’s decision is final and binding - no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. SMS is not a guaranteed delivery communication tool. The Promoter and the service provider cannot accept responsibility for any SMS messages not received by the Promoter or an entrant. All entries are deemed to be received at the time of receipt in the Promotional database and NOT time of transmission by the Entrant.
16. The Promoter reserves the right to disqualify any entrant who is involved in any way with interfering or tampering with the entry process, submitting an entry which is not in accordance with these Terms or if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
17. In the event that the winner does not claim their prize, cannot validate their winning entry or confirm their availability to use the prize as stipulated in these terms and conditions within 28 days of written notice being given that the entry is a winner, the Promoter may conduct further draws at the same place and time as the original major prize draw on 31/08/2012 (being at least 3 months after the date of the last prize draw) to distribute the prize if unclaimed by that date. All entries received will be entered in this unclaimed prize draw. Any prize winner of such draw will be notified in writing via email within five (5) working days of the draw and their name published in The Australian on 09/09/2012.
18. All claims and entries become the property of the Promoter. Each entrant agrees to do all things requested by the Promoter to ensure that the intellectual property rights in and to the entries become the property of the Promoter and to provide all consents necessary or requested by the Promoter in relation to moral rights.
19. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
20. Except for any liability which cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter and its associated companies are not responsible for and excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of: :
(a) any problems or technical malfunction (whether or not under the Promoter’s control) of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on any computer system or at any website, or any combination thereof, including (but not limited to) any injury or damage to participants or any other person’s property related to or resulting from participation in this Promotion;
(b) any incorrect or inaccurate information, either caused by users or by any of the equipment or programming associated with or utilised in connection with this Promotion, or by any technical error that may occur in the course of this Promotion;
(c) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or third part interference or unauthorised access to or alteration of entries or entrants details;
(d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter);
(e) any variation in prize value to that stated in these Terms and Conditions;
(f) any tax liability incurred by a winner or entrant (independent financial advice should be sought); or
(g) use of a prize.
21. In the event that any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the various lottery authorities.
22. Prize values are correct at time of printing but no responsibility is accepted for any variation in the value of any prizes.
23. The promotion may be changed or withdrawn at any time. In the event of any dispute, management of Stuart Alexander & Co Pty Ltd will be sole arbitrator and their decision will be final and is subject to written directions given by all relevant State and Territory Legislative Departments.
24. Caution: any attempt to deliberately damage the Promoter's promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.
25. Printing and other quality control errors will not invalidate an otherwise valid prize claim.
26. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. If the entrant has marked the “opt-in” box on their registration form, the entrant consents to the storage of their personal information on the Promoter’s database and the Promoter may use the information for future promotional, marketing and publicity purposes including contacting entrant in the future with information on special offers or provide entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. Entrants can also gain access to, update, correct or destroy any personal information or opt out of receiving any communications by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter.
